Citizen Engagement Improves Access to Public Goods in Mexico

A paper recently published in World Development brings new and fascinating evidence from Mexico of the impact of participatory governance mechanisms on access to services.

Below are a few excerpts from the paper by Diaz-Cayeros, Malagoni, and Ruiz-Euler “Traditional Governance, Citizen Engagement, and Local Public Goods: Evidence from Mexico” (emphasis are mine):

The goal of this paper is to assess the effects of traditional governance on local public good provision. We ask whether poor indigenous communities are better off by choosing to govern themselves through “traditional” customary law and participatory democracy, versus delegating decisions concerning the provision of public goods to “modern” forms of representative government, structured through political parties. This is a crucial question for developing countries seeking to enhance accountability, and a central problem in the theory of participatory democracy.

Our research design takes advantage of an important institutional innovation in the state of Oaxaca, Mexico, that in 1995 allowed indigenous communities to choose their forms of governance. The reform gave full legal standing to a form of traditional indigenous governance called usos y costumbres (usos hereafter), which entails electing individuals to leadership positions through customary law in non-partisan elections, making decisions through participatory democracy, and monitoring compliance through a parallel (and often informal) system of law enforcement and community justice. If they did not choose usos, municipalities could opt instead for party governance, which entails the selection of municipal authorities through electoral competition among political parties and the adjudication of conflicts only through the formal institutional channels, namely the state and federal judiciary.

Our results show that electricity provision increased faster in those municipalities governed by usos. They also suggest that traditional governance may improve the provision of education and sewerage. With respect to citizen engagement and elite capture, contrary to existing scholarly work, we find no evidence of entrenchment of local bosses (caciques) associated with the former ruling party, the Institutional Revolutionary party (PRI) in places ruled by usos. Our findings suggest that traditional participatory forms of governance do not handicap democratic development. Furthermore, municipalities governed by usos are more likely to hold open council meetings allowing citizens to participate in decisionmaking processes. We attribute better public goods coverage to differences in local governance and collective decisionmaking practices. We suggest three specific channels through which traditional governance affects local public good provision: the social embeddedness of municipal presidents, broader civic engagement in collective-decision making, and credible social sanctions. We argue that traditional governance practices (which include in our setting decision-making through direct participatory practices, the obligation to provide services for the community, and the establishment of a parallel system of justice), allow poor communities to better hold their political leaders accountable, prevent elite capture, and monitor and sanction non-cooperative behavior.

Systems of governance based on electoral competition among political parties differ essentially from usos because decisions are taken by politicians without an ongoing process of consultation with the citizenry. The monitoring and sanctioning dynamics that come into play when citizens gather in public assemblies are usually absent in party-run municipalities, and thus the allocation of resources for public goods seems sub-optimal.

Differences between the two types of governance that we presented in the paper point to a broader discussion of the organization of democracy. The delegated format of decision-making in electoral democracies dominated by political parties seems to bear a higher risk of agency loss than deliberative decision-making of what is often referred to as participatory democracy. (…) there are lessons to be extracted from the fact that, with regard to the provision of some basic services, a non-partisan political arrangement presented some advantages over the widespread electoral and party-based democratic organization. Participation and collective monitoring of authority are hugely important to maximize collective well-being.

Civil Society and Participation in Brazil: A Literature Review

This literature review is divided into six sections. The first section briefly describes the  theoretical and empirical background of debates about civil society and participation: the democratization process of the 1980s. The second section examines the first and second generation of studies of the best-known participatory mechanism in Brazil – participatory budgeting (PB). Next, this review turns attention toward research on policy councils, which fuelled more theoretical advances than studies of PB. A short section presents the few available studies about participation in the Northeast region of Brazil – a still largely unchartered territory in the literature. The fifth section discusses normative debates about the meaning and purpose of participation. Although the debate is not as contentious as it was in the early-2000s, two distinct views about participation still mark this literature. The last and longest section analyzes studies that treat citizen participation as a constitutive part of the representative system, which can help to improve government accountability and increase the quality of democracy.

How effective are whistleblower laws in combating corruption?

A new discussion paper by Rajeev Goel and Michael Nelson looks at the effectiveness of US whistleblower laws in combating corruption. The abstract is below:

Whistleblower laws are becoming important governance tools in both the public and private sectors. To examine the effectiveness of whistleblower laws and their awareness, this study creates a unique internet-based measure of awareness about whistleblower laws and provisions, focusing on the United States. Placing the analysis within the larger corruption literature, our results show that greater whistleblower awareness results in more observed corruption and this holds across specifications. Internet awareness of whistleblower laws appears to be more effective at exposing corruption than the quantity and quality of whistleblower laws themselves.

And a few excerpts from the conclusion, which highlights the role of the internet:

Couching the empirical analysis within the extant literature on the causes of corruption, our results show that greater internet awareness about whistleblower laws results in more corruption coming to light and being successfully prosecuted. In terms of magnitude, an increase in whistleblower hits by one sample standard deviation would increase average corruption convictions per million population by nearly thirty over a decade-long period. Interestingly, the internet awareness about corruption seems relatively more effective at exposing corruption than the quantity and quality of whistleblower laws themselves. Further, the direct government resources allocated to controlling crime and the indirect efforts via whistleblower awareness are found to be complementary. These findings are generally robust to alternate specifications, including an allowance for potential endogeneity of whistleblower awareness, and to broader measures of internet whistleblower awareness. The results for the United States in terms of the effectiveness of whistleblower laws in exposing corruption should be of interest to policy makers everywhere, especially in other nations that do not have adequate protections for whistleblowers. As internet diffusion grows and the digital divide narrows, it would be interesting to see a further impact of whistleblower awareness and, more generally, of the internet.

New Book on Open Parliaments

Brazilian House of Representatives

Cristiano Faria’s book on Open Parliaments has finally been translated from its original Portuguese to English. There are many reasons to read Cristiano’s piece, one of them being the scarcity of literature dealing with the usage of ICT by the legislative branch. I was honoured to be invited to write the preface to this book, in which I list a few other reasons why I think this book is very worthwhile reading. I have reproduced the preface below, with the addition of some hyperlinks.

Towards the end of the 18th Century, not long after the French Revolution, engineer Claude Chappe invented the optical telegraph. Also known as the Napoleonic Telegraph, this technological innovation enabled the transmission of messages over great distances at unprecedented speeds for its time. This novelty did not go unnoticed by the intellectuals of the period: the possibility of establishing a telegraph network that could connect individuals at high speed and lowered costs was seen as a unique opportunity for direct democracy to flourish.

The difficulties associated with direct democracy, so eloquently expressed by Rousseau just a few years earlier, no longer seemed relevant: simply opening the code used by the telegraph operators would suffice for a whirlpool of ideas to flow between citizens and government, bringing a new era of participatory decision-making. Events, however, took a different turn, and as time went by the enthusiasm for a democratic renewal faded away.

In the course of the centuries that followed, similar stories abounded. The emergence of each new ICT gave rise to a period of enthusiasm surrounding a renewal in politics and government, only to be followed by bitter disillusionment. While the causes of these historical experiences are multiple, it is safe to say that the failure of these technologies to deliver their much-heralded potential is underscored by a lack of understanding of the role of political institutions. These institutions are, inexorably, sources of obstacles and challenges that go beyond the reach of technological solutions.

Indeed, one could argue that despite the historical evidence, even today a certain amount of ingenuity permeates the majority of academic works in the domain of electronic democracy and open government, overestimating technological innovation and neglecting the role of institutions, actors, and their respective strategies.

Not falling prey to the techno-determinist temptation but rather carrying out an analysis grounded in institutions, organizational processes and actors’ strategies, is one of the many strengths of Cristiano Faria’s work. His experience as a civil servant in the Brazilian House of Representatives and his academic rigour bring together qualities that are rarely combined in the literature about the public sector. The result is a work that offers an unusual vision, taking into account a wide range of factors involved in processes of technological enactment and institutional innovation.

While underpinning the book as a whole, this encompassing perspective is most prominent in Chapters 4 and 5, in the case studies on the experiences from Brazil (e-Democracy) and Chile (Virtual Senator). Motivating factors, constraints, and institutional and organizational arrangements are brought to light. The reader encounters elements and processes that often go unperceived by even the most attentive observers and experienced academics.

For instance, while analysing the Brazilian case, Cristiano underscores the essential role played by legislative consultants in channelling citizens’ input into the formal decision-making processes of the House of Representatives. Only an individual who is viscerally familiar with the functioning of the public institutions in question is capable of such an insight – one of many throughout the book.

Even for this reason alone, this work is of inestimable value to the Brazilian and international literature in the fields of electronic democracy and open government. Numerous other characteristics, however, further add to its worth for researchers, politicians, civil servants and ordinary citizens with an interest in these subjects.

The object of study is relevant in itself. There is a disproportionate shortage of literature about the role of technologies with regard to the legislative branch. An incomplete understanding of how public institutions operate and interact among themselves has led an increasing number of academics and observers to focus their attention on the executive branch. Furthermore, in the limited literature that is available about the use of technologies by the legislative, the majority of studies are disappointingly superficial or excessively descriptive.

Cristiano’s text, although rich in detail, never loses sight of the major theoretical and normative perspectives that inform the state of the art in the electronic democracy debate. The literature that guides this piece is impeccable. This is a text that brings the reader into contact with the main theories and arguments relating to issues of transparency, participation, actors’ strategies, and processes of institutional and technological innovation.

Lastly, by presenting cases ranging from New Zealand to the Catalan Parliaments, this book has the inestimable worth of being a historical record, immune to temporal and technological changes. Cristiano Faria captures the state of the art in electronic democracy experiences in the legislative at the beginning of the 21st century. To ensure that the destiny of these experiences differs from that of the Napoleonic Telegraph, a realistic and perspicacious reflection is necessary, to which this book makes its contribution.

Infotopia – Unleashing the Democratic Power of Transparency

Archon Fung has just published a new paper in Politics & Society, “Infotopia: Unleashing the Democratic Power of Transparency”.

Abstract

In Infotopia, citizens enjoy a wide range of information about the organizations upon which they rely for the satisfaction of their vital interests. The provision of that information is governed by principles of democratic transparency. Democratic transparency both extends and critiques current enthusiasms about transparency. It urges us to conceptualize information politically, as a resource to turn the behavior of large organizations in socially beneficial ways. Transparency efforts have targets, and we should think of those targets as large organizations: public and civic, but especially private and corporate. Democratic transparency consists of four principles. First, information about the operations and actions of large organizations that affect citizens’ interests should be rich, deep, and readily available to the public. Second, the amount of available information should be proportionate to the extent to which those organizations jeopardize citizens’ interests. Third, information should be organized and provided in ways that are accessible to individuals and groups that use that information. Finally, the social, political, and economic structures of society should be organized in ways that allow individuals and groups to take action based on Infotopia’s public disclosures.

The Uncertain Relationship Between Open Data and Accountability

My article in response to Yu and Robinson’s recent paper on open data has just been published in the UCLA Law Review Discourse: The Uncertain Relationship Between Open Data and Accountability: A Response to Yu and Robinson’s The New Ambiguity of “Open Government”

Below is the abstract:

By looking at the nature of data that may be disclosed by governments, Harlan Yu and David Robinson provide an analytical framework that evinces the ambiguities underlying the term “open government data.” While agreeing with their core analysis, I contend that the authors ignore the enabling conditions under which transparency may lead to accountability, notably the publicity and political agency conditions. I argue that the authors also overlook the role of participatory mechanisms as an essential element in unlocking the potential for open data to produce better government decisions and policies. Finally, I conduct an empirical analysis of the publicity and political agency conditions in countries that have launched open data efforts, highlighting the challenges associated with open data as a path to accountability.

As I wrote the article, it became even more evident to me that the challenges for open data resemble those of democracy. To be successful, both depend on free press, fair elections, and multiple avenues of citizen participation. The resemblance goes one step further: both are most needed where they are least likely to thrive. On democracy and challenging environments, political scientist Robert Dahl wrote:

Democracy, it appears, is a bit chancy.  But its chances also depend on what we do ourselves.  Even if we cannot count on benign forces to favor democracy, we are not mere victims of blind forces over which we have no control. With adequate understanding of what democracy requires and the will to meet its requirements, we can act to preserve and, what is more, to advance democratic ideas and practices

May Dahl’s call resonate with the open data movement.

A Dynamic Model of Protest

A nice animation based on a paper by Adam Meirowitz (Princeton) and Joshua Tucker (New York University). The video explains why citizens who take action to overthrow bad governments might eventually lose hope  and decide to stay home.

 

The paper was published this year in the American Journal of Political Science. Here is the abstract:

In the aftermath of the Arab Spring, a crucial question is whether popular protest is now likely to be a permanent part of Middle Eastern politics or if the protests that have taken place over the past two years are more likely to be a “one-shot deal.” We consider this question from a theoretical perspective, focusing on the relationship between the consequences of protests in one period and the incentives to protest in the future. The model provides numerous predictions for why we might observe a phenomenon that we call the “one-shot deal”: when protest occurs at one time but not in the future despite an intervening period of bad governance. The analysis focuses on the learning process of citizens. We suggest that citizens may not only be discovering the type or quality of their new government—as most previous models of adverse selection assume—but rather citizens may also be learning about the universe of potential governments in their country. In this way, bad performance by one government induces some pessimism about possible replacements. This modeling approach expands the formal literature on adverse selection in elections in two ways: it takes seriously the fact that removing governments can be costly, and it explores the relevance of allowing the citizen/principal to face uncertainty about the underlying distribution from which possible government/agent types are drawn.

The authors’ highlighting of the need to “get it right” in the first transitional elections comes as a reminder of how frail electoral democracy may be in recently transitioned countries. A snapshot from the conclusion (ungated version):

In the aftermath of events like the Arab Spring and the Colored Revolutions, we are once again confronted with the question of what the long-range effects are likely to be of regime change ushered in by citizens taking to the streets. Such moments are often filled with optimism about the potential for people to seize control of their own destiny and finally demand accountability from their governments. The model we present in this article does not deny that this optimistic chain of events can come to fruition, but it does lead to important insights as to when such a scenario is more or less likely.

First, there is likely to be a fundamental difference between what happens following a protest that leads to regime change as opposed to one that leads merely to a change of government without changing the regime. So a protest in France that leads to a change in the government—for example, the 1968 protests and subsequent resignation of de Gaulle (Cerny 1970)—is not likely to change citizens’ minds about the overall distribution of the quality of governments available through French democracy. Citizens may feel that they have received a “bad” draw from this distribution, and thus it is worth trying to throw the current government out of power and replace it with a new draw from the same distribution. In these circumstances—provided the cost of protesting remains constant—there is no reason not to expect French citizens to take to the streets to protest against their government in similar numbers in thefuture.

In a new democracy, however, we suggest that citizens may be simultaneously updating about the quality of the current government and the potential quality of all governments available under a democratic regime. This learning may be rather dramatic during the first governments of the new regime. If these initial governments after a democratic transition should prove to be little better than previous nondemocratic governments, citizens might be unlikely to take costly actions in order to curtail new abuses or even deter a blatant disregard for the new rules calling for periodic elections. Thus, we are probably most likely to see a one-shot-deal scenario when the initial governments following a democratic transition are perceived as no better than the ones that preceded the transition. Conversely, repeated protest might be more likely if there are afew “good” governments—thus leading respondents to think that the average quality of government is indeed better under democracy—before a government that might threaten democracy appears again. The bottom line is that if the type of learning that underlines our model is indeed occurring in newly democratic regimes, then the stakes for these regimes during the initial post-transition governments are likely to be high indeed.

Taken together, these points suggest the potential for the following patterns to emerge. The size and strength of protests may increase over time in a nondemocratic regime, but once the initial goal of removing the old regime from office is accomplished, the ability of prodemocracy forces to bring their supporters to the street may diminish significantly. The intuitive explanation for such a pattern would normally be that “the goal has been met,” but our model suggests a different story: it may not be so much that the goal has been met as the goal no longer seems to be quite so valuable. Again, this points to the importance of “getting it right” in the first transitional elections.

Diamond’s Course on Democratic Development

I just found out that on April 3rd Coursera started offering a new series of lectures on Democratic Development with Larry Diamond. Here’s a brief description of the course:

This course is intended as a broad, introductory survey of the political, social, cultural, economic, institutional, and international factors that foster and obstruct the development and consolidation of democracy. Each factor will be examined in historical and comparative perspective, with reference to a variety of different national experiences. Students are encouraged to relate the historical development and contemporary situation of particular countries and regions (especially their own) to the various theories about democratic development, and to evaluate those theories in light of country experience. It is also hoped that students in developing or prospective democracies can use the theories, ideas, and lessons in the class to help build or improve democracy in their own countries.

Although it seems that Larry will not approach the issue of participatory democracy, there is little doubt that it is something worth following if one looks at the syllabus. The reading schedule [PDF] is – as one would expect – impeccable, and it is in itself a valuable list of resources for those who would like to move beyond a simplistic understanding of democracy.To set the tone, one of the first suggested readings is the brilliant “What Democracy Is…and Is Not”, a classic by Philippe Schmitter and Terry Karl, who together form probably one of the most brilliant (and charming) couples ever. The list of excellent readings goes on forever, with major scholars (beyond Larry himself) such as Lipset, O’Donnel, Lijphart, Carothers and Horowitz.Touching upon issues like ethnic conflict, accountability, rule of law and control of corruption, this course might also be of interest to many development practitioners working in related fields. Personally – and despite the sometimes tiring hype – I look forward to hearing more from Diamond about his take on the role of technologies in democratic transitions (see for instance, this paper of his “Liberation Technology” [PDF]).

Albeit free, this course is priceless.

Trac FM – Monitoring Service Delivery

The Indigo Trust has awarded a grant of €13,500 to TRAC.fm to expand the network of organisations that use its data collection software to inform their social campaigns.

Trac FM provides radio stations in Africa with software and support to involve their listeners in reporting on failing governments services through SMS. Through Trac FM’s online interface, radio presenters get a clear and instant overview of SMS-poll results which they present to listeners during radio debates. Stations invite local leaders to comment on collected data and Trac FM makes sure data reaches responsible authorities. Trac FM wants people to be part of the running of their society and provide them with a platform to participate and discuss policy issues in an accessible and objective way.

Interesting initiative. Would be interested in finding out whether they measure their impact on service delivery and, if so, how.

Citizen Engagement – Seven Questions, One Conversation

Calls for increased citizen empowerment are heard from across the spectrum, ranging from governments and donors to CSOs and multilateral efforts such as the Open Government Partnership.

The World Bank Group, in partnership withCIVICUS, the Government of Finland andInterAction will host a conference on citizen engagement on March 18, 2013 to highlight the value of engaging with citizens for effective development.

The Citizen Voices conference will focus on citizen engagement and feedback systems that strengthen the quality of policy making and service delivery, where the impact on the poor is most direct. The conference aims to explore how citizen engagement is essential for effective development, move from knowledge to action, and establish concrete partnerships for scaling up at global and national levels.

But while the claims for citizen engagement abound, less discussion is dedicated to how to design and implement participatory processes that deliver their expected benefits, such as increased accountability and better delivery of policies and services. As part of this problem, not enough attention is paid to the various outcomes that participatory processes may engender and what they mean for policy and development.

For instance, in some cases participation may lead to disappointing results, such as citizens’ mistrust of government, elite capture and public opinion polarization. Conversely, participation can also be associated with surprisingly positive outcomes, such as increased levels of tax compliance and reduced infant mortality. But how can we explain these disparities in results?

Shedding light on the question of when, why and how participation works is precisely the objective of this conversation. Thus, to kick off the debate, I would like to start by considering seven questions:

  • How can we measure the success of citizen engagement initiatives?
  • How essential are processes of organizational and institutional change?
  • Can political will towards increased participation be stimulated?
  • What role does organized civil society play in citizen engagement processes?
  • How can we foster inclusiveness and what are the impacts of different methods of participant selection (e.g. open, randomized)?
  • Can we learn anything from the private sector about listening to external audiences?
  • What is the actual role of technology (if any) in participatory processes?

Parallel to the event, and running until the end of this month, the World Bank has launched an online conversation on citizen engagement to help tackling these and other issues. Needless to say, the questions are far from exhaustive. Maybe some are even secondary. But I believe that considering them might bring us closer to answering an even more fundamental question: that is, how can we leverage the dispersed knowledge of citizens to shape decisions that affect their lives?
